Terms of Use

1. Website terms only

These Terms apply to the public Website. They do not govern access to or use of the Netblinks analytics platform, professional services, trials, or paid services. Those offerings are governed by a separate written agreement, order form, data processing addendum, or other terms agreed between Netblinks and the customer. If there is a conflict, the signed customer agreement controls for the covered service.

2. Eligibility and authority

You must be at least 18 years old, or the age of legal majority where you live, to use the Website. If you use the Website on behalf of a company or other organization, you represent that you have authority to act for that organization and bind it to these Terms.

3. Information on the Website

The Website provides general information about Netblinks and its proposed or available products and services. Website content, demonstrations, examples, roadmaps, integrations, performance descriptions, and availability statements may change and do not create a binding commitment unless included in a separate written agreement signed by Netblinks.

Nothing on the Website is legal, financial, accounting, medical, security, or other professional advice. You are responsible for evaluating information and obtaining appropriate professional advice before making decisions.

4. Demonstration requests and communications

You may submit accurate contact and business information to request a demonstration. Submission does not guarantee that Netblinks will provide a demonstration, enter a business relationship, or make a product available.

By submitting a request, you authorize Netblinks to contact you about that request using the details you provide. This does not enroll you automatically in unrelated promotional email campaigns. Our handling of personal information is described in the Netblinks Privacy Policy.

Do not submit passwords, access tokens, database credentials, production data, regulated data, trade secrets, or other sensitive or confidential information through the public form. Information submitted before the parties sign a confidentiality agreement is not subject to confidentiality obligations unless applicable law requires otherwise.

5. Acceptable use

You may use the Website only for lawful purposes. You must not, and must not help another person to:

• Violate applicable law or another person’s rights.
• Submit false, misleading, fraudulent, infringing, or unlawful content.
• Impersonate another person or misrepresent your authority or affiliation.
• Introduce malware or attempt to disrupt, overload, damage, or impair the Website.
• Probe, scan, or test a vulnerability without prior written authorization.
• Bypass access, rate, security, or use restrictions.
• Access non-public systems or data without authorization.
• Use automated means to extract Website content in a manner that imposes an unreasonable load or violates applicable law.
• Reverse engineer or attempt to derive source code except to the limited extent a restriction is prohibited by applicable law.
• Systematically copy protected Website content to develop, train, or improve a competing product or service, except where expressly permitted in writing or required by law.

We may restrict or block access when we reasonably believe it is necessary to protect the Website, users, Netblinks, or others, or to comply with law.

6. Intellectual property

The Website and its content—including text, visual design, graphics, logos, product names, demonstrations, software, and other materials—are owned by Netblinks or its licensors and protected by intellectual-property laws.

Subject to these Terms, Netblinks grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for your internal business evaluation. No other license or right is granted by implication, estoppel, or otherwise. You may not use Netblinks names, logos, or trademarks without prior written permission, except as permitted by law.

7. Feedback

If you voluntarily provide suggestions or feedback about the Website or Netblinks offerings, you grant Netblinks a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not give Netblinks ownership of your pre-existing intellectual property or confidential business information.

8. Product demonstrations and AI-generated material

Product tours, screenshots, sample questions, visualizations, dashboards, and AI-generated outputs shown on the Website are illustrative. Actual results depend on connected data, configuration, permissions, models, controls, and the customer environment.

AI-assisted output may be incomplete or inaccurate and should be reviewed by an appropriately qualified person before it is used for operational, financial, legal, safety-critical, or other consequential decisions. Website demonstrations are not a warranty of product performance.

9. Third-party services and links

The Website may rely on or link to third-party services. Netblinks does not control third-party websites, content, availability, security, or privacy practices. A link does not imply endorsement. Your use of a third-party service is governed by that provider’s terms and privacy notice.

10. Disclaimers

To the fullest extent permitted by law, the Website and all content are provided “as is” and “as available.” Netblinks disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.

Netblinks does not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that Website content will always be complete, current, or accurate.

Some jurisdictions do not permit certain warranty exclusions, so portions of this Section may not apply to you. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Netblinks and its officers, directors, employees, affiliates, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Website or these Terms, even if advised that such damages are possible.

To the fullest extent permitted by law, their total aggregate liability for all claims arising from or related to the Website or these Terms will not exceed the greater of (a) US $100 or (b) the amount you paid Netblinks, if any, specifically for use of the public Website during the 12 months before the event giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded. Separate customer agreements may contain different liability terms for Netblinks products and services.

12. Indemnification

To the extent permitted by law, if you use the Website on behalf of a business or organization, that business or organization will defend, indemnify, and hold harmless Netblinks and its officers, directors, employees, affiliates, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable legal fees arising from its unlawful use of the Website, violation of these Terms, or infringement of another person’s rights.

This Section does not require indemnification for Netblinks’ own fraud, willful misconduct, or other conduct for which indemnification cannot lawfully be required.

13. Changes to the Website or Terms

We may modify or discontinue all or part of the Website. We may also update these Terms to reflect changes to the Website, our practices, or applicable law. Updated Terms will be posted with a revised “Last updated” date.

Material changes apply prospectively. Where required by law, we will provide additional notice or obtain consent. Continuing to use the Website after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to updated Terms, stop using the Website.

14. Governing law and courts

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to any mandatory rights you have under the law where you live, the state courts located in Travis County, Texas, and the federal courts in the Western District of Texas, Austin Division, will have exclusive jurisdiction over disputes arising from these Terms or the Website, and each party consents to those courts’ jurisdiction.

15. General terms

If a court finds part of these Terms unenforceable, that part will be enforced to the maximum lawful extent and the remaining Terms will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or by operation of law.

These Terms and the Privacy Policy are the entire agreement between you and Netblinks concerning the public Website, but they do not replace any separate written agreement covering Netblinks products or services.
